Terms and Conditions YourClassicalFeed

Article 1 – Definitions

  1. YourClassicalFeed: the company offering classical music marketing via social media.
  2. Client: the natural or legal person making use of the services of YourClassicalFeed.
  3. Services: the creation, publication, and distribution of content about classical music via social media in collaboration with third parties.
  4. Agreement: the arrangements between YourClassicalFeed and the Client regarding the services to be provided.

Article 2 – Applicability

  1. These terms and conditions apply to all offers, agreements, and services of YourClassicalFeed.
  2. Deviations from these terms are only valid if agreed upon in writing.

Article 3 – Services and Collaborations

  1. YourClassicalFeed creates and publishes content about classical music in collaboration with third parties, such as musicians, composers, and labels.
  2. Content is posted on the social media channels of YourClassicalFeed and/or the client.
  3. The exact content and frequency of the posts are agreed upon per assignment.

Article 4 – Compensation and Payment

  1. A fee is charged for the services, as agreed in the agreement.
  2. Payment must be made within 14 days of the invoice date, unless otherwise agreed.
  3. In case of late payment, the client owes statutory interest, and access to the services may be suspended.

Article 5 – Intellectual Property

  1. All content created by YourClassicalFeed remains the property of YourClassicalFeed unless otherwise agreed in writing.
  2. The client receives a non-exclusive right to use the content, limited to the agreed channels and period.

Article 6 – Liability

  1. YourClassicalFeed is not liable for any damages arising from inaccuracies in the content or from the use of the content by the client.
  2. If YourClassicalFeed is nevertheless held liable, this is limited to the amount charged for the relevant assignment.

Article 7 – Termination and Cancellation

  1. Both parties may terminate the agreement in writing, observing a notice period of 30 days.
  2. If the client cancels the assignment after work has commenced, they are obliged to pay the costs already incurred and a reasonable part of the agreed fee.

Article 8 – Force Majeure

  1. YourClassicalFeed is not obliged to fulfill obligations if force majeure occurs, such as technical failures or external factors beyond the control of YourClassicalFeed.

Article 9 – Disputes and Applicable Law

  1. These terms and conditions are governed by Dutch law.
  2. Disputes are preferably resolved through mutual consultation. If this is not possible, they will be submitted to the competent court in the Netherlands.
